What Happened: Missouri Signs HB 2641
At a 2:30 p.m. bill-signing ceremony on April 23, 2026, Governor Mike Kehoe signed House Bill 2641, sponsored by Representative Dave Hinman (R-O’Fallon), alongside three other pieces of legislation. The bill had cleared the Missouri House 126 to 23 on April 2 after the Senate passed it the night before.
The governor had signaled support since his January State of the State address, when he identified regulating intoxicating hemp as a priority. Opposition was vocal: the Missouri Hemp Trade Association hand-delivered roughly 10,000 handwritten letters to the Governor’s office, and Missouri Attorney General Catherine Hanaway, who publicly supported the bill, has sent 33 cease-and-desist letters to retailers since November.
What HB 2641 Does (and What It Won’t)

What products are affected by HB 2641?
HB 2641 reclassifies any hemp-derived product with more than 0.4 mg of total THC per container as marijuana. After November 12, 2026, those products can only be sold through state-licensed dispensaries. That affects most Delta-9 THC gummies, THCA flower, Delta-8 THC vapes, THC seltzers, and other intoxicating hemp formats currently sold at general retail.
Can I still buy Delta-9, Delta-8, THCA, and THC seltzers in Missouri?

Yes. Non-intoxicating CBD, CBG, CBN, and broad spectrum hemp products under the 0.4 mg per container cap can be affected.
Can I still buy THC seltzers and edibles in Missouri after November 12, 2026?
After the effective date, products over the 0.4 mg cap can only be sold through Missouri’s state-licensed marijuana dispensary system. Because Missouri requires dispensary products to be grown in state-licensed facilities, national hemp brands may not have a practical path into that channel, which is why industry groups describe the law as significantly narrowing the intoxicating hemp category in Missouri.
