The quick answer
As of July 1, 2026, kratom is illegal to sell, ship, possess, or use in Tennessee. The ban covers every form, including leaf powder, capsules, teas, extracts, and products containing 7-hydroxymitragynine (7-OH). In line with the law, CBD Kratom does not sell or ship kratom to Tennessee addresses. Tennessee customers can still order CBD, CBN, and CBG products, which remain legal.
What the new law does
The ban comes from House Bill 1649, known as Matthew Davenport's Law, which Governor Bill Lee signed on May 7, 2026 as Public Chapter 950. It cleared the Tennessee House 78 to 9 and the Senate 23 to 3, and it took effect on July 1, 2026. With it, Tennessee became the eighth state to fully prohibit kratom.
The statute defines kratom to include mitragynine, 7-hydroxymitragynine, and their derivatives. That definition matters: unlike some other states that limited their rules to concentrated 7-OH products, Tennessee's ban reaches the natural leaf as well.
What is covered
The ban applies to all kratom product formats, including:
- Powdered kratom leaf
- Capsules and tablets
- Teas and shots
- Extracts and concentrated 7-OH products
There is no retail or consumer grace period written into the law, so the prohibition applied in full on July 1, 2026.
The penalties, in plain terms
Under the statute, knowingly possessing kratom is a Class A misdemeanor, which can carry up to 11 months and 29 days in jail and a fine of up to $2,500. Manufacturing, delivering, or selling kratom is a Class C felony. This is one reason a licensed retailer cannot legally ship kratom into the state.
